These Terms of Service (“Terms”) constitute a legally binding agreement between EliteStarHosting (“we,” “us,” “our”) and the customer (“you,” “your”) regarding the use of any service provided by EliteStarHosting.
By registering for, purchasing, or using our services (including but not limited to Minecraft, FiveM, Rust or Discord bot hosting), you confirm that you have read, understood, and accepted these Terms. We may update or modify these Terms at any time. The latest version will always be available at https://elitestarhosting.com/legal Continued use of our services after such updates constitutes acceptance of the revised Terms.
EliteStarHosting provides digital hosting services, including but not limited to:
・Minecraft Server Hosting
・FiveM Server Hosting
・Rust Server Hosting
・Discord Bot Hosting
All services are delivered digitally and activated immediately upon successful payment or credit allocation.
We reserve the right to modify, upgrade, or discontinue any service at any time, with reasonable notice when feasible.
Services are billed either through a subscription or credit-based system.
Credits are virtual and have no real-world monetary value. They may only be used within the EliteStarHosting platform.
All payments and credit purchases are final and non-refundable.
Failure to maintain sufficient credits or renew your subscription may result in temporary suspension or termination of your service.
Pricing and payment structures may be updated at any time.
In accordance with Article 6:230p sub g of the Dutch Civil Code (Burgerlijk Wetboek) and the EU Directive 2011/83/EU on Consumer Rights, the 14-day withdrawal right does not apply to digital services delivered immediately upon purchase with the consumer’s explicit consent.
By placing an order, you expressly agree that:
・The service will be activated immediately after payment; and
・You waive your statutory right of withdrawal once the service delivery begins.
Since hosting services are automatically and instantly provisioned, no refunds are possible after activation, even if the service remains unused.
We aim for high uptime and reliability, but services are provided on a best-effort basis, without any guarantee of uninterrupted operation.
Scheduled or unscheduled maintenance may occur at any time and may temporarily affect service availability.
EliteStarHosting is not liable for downtime, interruptions, data loss, or damages caused by maintenance, hardware failure, or third-party network issues.
You agree to use our services in full compliance with all applicable laws.
You may not use our services to:
・Engage in illegal activities, including hosting pirated, copyrighted, or malicious content.
・Distribute malware, DDoS tools, or launch any form of cyberattack.
・Infringe intellectual property rights of others.
・Abuse or overload our systems or networks.
Any violation may result in immediate suspension or termination of your service, without refund.
Severe or repeated violations may result in permanent bans or legal action.
While we may perform internal backups, data integrity is the customer’s responsibility.
EliteStarHosting is not responsible for data loss or corruption caused by you, software errors, or external interference.
Customers should maintain independent backups of all critical files.
Services may be suspended or terminated if:
・You violate these Terms or the Acceptable Use Policy.
・Payments are overdue.
・Abuse, fraud, or unauthorized access is detected.
Upon termination, all related data may be deleted permanently without recovery.
Customers may cancel at any time, but unused time or credits are not refundable.
To the maximum extent permitted by law:
・EliteStarHosting is not liable for any indirect, incidental, or consequential damages.
・Our total liability shall not exceed the amount paid by you in the 30 days prior to the event.
Services are provided “as is” and “as available,” without any warranty of any kind.
You accept full responsibility for your use of the services.
You agree to indemnify and hold harmless EliteStarHosting, its affiliates, employees, and partners against all claims, damages, and expenses arising from your misuse of our services or breach of these Terms.
These Terms are governed by the laws of the Kingdom of the Netherlands.
Any disputes shall be exclusively resolved in the District Court of Groningen, the Netherlands.
